This Terms of Service agreement (“Agreement”) is entered into by and between Majorkee Lashes (“Company,” “we,” “us,” or “our”) and any individual or entity accessing or using our website, products, services, or mentorship programs (“User,” “you,” or “your”). By accessing, browsing, purchasing, or using any part of our Services, you acknowledge that you have read, understood, and agree to be legally bound by this Agreement and all policies referenced herein.

Majorkee Lashes operates an online store, educational platform, and related services designed to provide beauty products and business mentorship. The Services are facilitated through third-party infrastructure, including Shopify, which enables the operation of our e-commerce platform. If you do not agree to these Terms, you must immediately cease use of the Services.

You represent and warrant that you are at least the age of majority in your jurisdiction or have obtained appropriate legal consent to use the Services. You further agree that all information provided by you, including but not limited to personal, billing, and account information, is accurate, complete, and current. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. Any unauthorized use resulting from your failure to secure your account shall be your sole responsibility.

The Company provides beauty-related products, including lash supplies, as well as educational services, including but not limited to a 5-Week Online Mentorship Program conducted through live sessions via Zoom. The mentorship program includes structured lessons, coaching, question-and-answer sessions, practical assignments, and accountability guidance. Participation in any mentorship or educational service requires your active engagement and implementation of the strategies provided.

You acknowledge and agree that all educational content, mentorship guidance, and business strategies provided by the Company are for informational and educational purposes only. The Company makes no guarantees regarding specific results, financial outcomes, business success, or personal performance. Any outcomes achieved are solely dependent on your individual effort, consistency, decision-making, and external factors beyond the Company’s control.

All products, services, and mentorship programs are offered subject to availability and acceptance by the Company. The Company reserves the right, at its sole discretion, to refuse, cancel, or limit any order or service for any reason. Product descriptions, pricing, availability, and other information are subject to change at any time without prior notice. The Company does not warrant that product representations, including images or descriptions, will exactly match the physical product received due to variations in display settings and other factors.

All prices are listed in the applicable currency and must be paid in full prior to access to any products or services. You agree to provide accurate payment information and authorize the Company to charge your designated payment method. Prices do not include applicable taxes, shipping, handling, or additional fees unless otherwise stated. The Company reserves the right to modify pricing, promotions, or discounts at any time without prior notice.

All sales related to mentorship programs, digital products, and educational services are final. Due to the nature of these services, no refunds, cancellations, or partial refunds shall be provided once access has been granted, including in cases of missed sessions or failure to participate. Physical product returns, if applicable, shall be governed by a separate refund policy.

Delivery timelines for physical products are estimates only and are not guaranteed. The Company shall not be held liable for delays caused by shipping carriers, customs, or events beyond its control. Title and risk of loss transfer to you upon delivery of the product to the carrier.

All content provided through the Services, including but not limited to text, images, videos, training materials, systems, branding, and intellectual property, is owned by or licensed to Majorkee Lashes and is protected under applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable right to access and use the Services for personal, non-commercial use only. You shall not reproduce, distribute, modify, create derivative works from, or exploit any content without prior written consent from the Company.

You agree to use the Services only for lawful purposes and in accordance with this Agreement. You shall not engage in any activity that violates applicable laws, infringes on intellectual property rights, transmits harmful code, interferes with the operation of the Services, or harms the Company or other users. The Company reserves the right to suspend, restrict, or terminate your access to the Services without notice if you violate these Terms.

The Services may include access to third-party platforms, tools, or services, including but not limited to Zoom and Shopify. You acknowledge that such third-party services are not controlled by the Company, and the Company shall not be responsible for their performance, availability, or policies. Your use of such services is at your own risk.

Your personal information is collected, used, and processed in accordance with the Company’s Privacy Policy. By using the Services, you consent to such collection and processing, including data handling by third-party providers as necessary to deliver the Services.

The Services and all products are provided on an “as is” and “as available” basis without any warranties of any kind, whether express or implied. The Company does not guarantee uninterrupted, secure, or error-free operation of the Services and disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities arising from or related to your use of the Services or products.

You agree to indemnify, defend, and hold harmless Majorkee Lashes, its affiliates, employees, contractors, and partners from any claims, liabilities, damages, or expenses arising out of your breach of this Agreement, violation of law, or misuse of the Services.

The Company reserves the right to terminate or suspend your access to the Services at any time, without notice, for any violation of this Agreement or for any conduct deemed harmful or inappropriate. Provisions relating to intellectual property, limitation of liability, indemnification, and governing law shall survive termination.

Any feedback, suggestions, or submissions provided by you to the Company may be used without restriction or compensation. You grant the Company a perpetual, irrevocable, worldwide, royalty-free license to use such content for any purpose, including commercial use.

The Company reserves the right to correct any errors, inaccuracies, or omissions on the website or within the Services at any time without prior notice.

This Agreement shall be governed and interpreted in accordance with the laws of the jurisdiction in which Majorkee Lashes operates. You agree to submit to the exclusive jurisdiction of the courts in that location.

The Company reserves the right to update, modify, or replace any part of this Agreement at any time. Continued use of the Services following any changes constitutes acceptance of those changes.
